Guidelines for Enhancing the Effectiveness of Police Officers’ Performance in Accordance with the Prevention and Suppression of Torture and Enforced Disappearance Act, B.E. 2565 (2022)

Abstract

This research aimed to: 1) examine the problems and obstacles faced by police officers in performing their duties under the Prevention and Suppression of Torture and Enforced Disappearance Act, B.E. 2565 (2022); and 2) propose guidelines for enhancing the effectiveness of police officers’ performance under the same Act. The key informants were police officers whose duties were related to the Act. A qualitative research approach was employed, using purposive sampling to select 15 participants. Data were collected through in-depth interviews. The key informants were categorized into three groups: 1) commissioned officers in supervisory positions, 2) operational officers, and 3) related stakeholders involved in the implementation of the Act.

The findings revealed that: 1) problems in police operations under the Act occurred at all stages of the process, including arrest, detention, transfer of custody, and investigation of enforced disappearance cases. These problems included limitations in resources and technology, a lack of standardized operational procedures, and insufficient inter-agency coordination. Although the Act aimed to protect human rights, its implementation was hindered by unclear legal interpretations, time constraints, and ineffective collaborative mechanisms, resulting in limited enforcement efficiency. 2) Five key issues were identified: fostering an organizational culture that respects human rights, enhancing legal knowledge and skills, developing a systematic victim protection framework, establishing transparent internal monitoring and accountability systems, and strengthening inter-agency cooperation. These issues were considered essential mechanisms for promoting lawful, effective, and accountable enforcement of the Act.
