LAW PROBLEMS OF REGULATORY IMPACT ASSESSMENT : (RIA) ACCORDING TO SECTION 77 OF CONSTITUTION OF THE KINGDOM OF THAILAND, B.E. 2560

Abstract

This research aimed to study the law problems of regulatory impact assessment (RIA) according to section 77 of Constitution of the Kingdom of Thailand, B.E. 2560 in order to provide the development ways of law quality improvement that leads to good and superfine law. Besides, this research was done in order to provide the standard practice in law quality improvement by providing appropriate ways that correspond to Thailand context that were:  suggest the creation of the bill that supports section 77 in the form of act instead of using current cabinet resolution. The persons with the right of bill proposal should do RIA not only the government organizations but also the cases of population and member of the House of Representatives with the aid of the Secretariat of the House of Representatives, the Office of Law Reform Commission of Thailand and King Prajadhipok's Institute in order to help people to create and propose bill. In addition, regulatory impact assessment should be done by the member of the House of Representatives with the aid of the Secretariat of the House of Representatives in creating bill and doing regulatory impact assessment. By having the Office of the Council of State organizations that were the same organizations as regulatory impact assessment organizations in order to take part in regulatory achievement assessment, the persons who take responsibilities in regulatory achievement assessment should be on duty as the deputy according to the specific law. The types of law that should do RIA were the laws that related to the act such as acts and code of laws in the form of meaning and in the case of secondary laws. If the details of secondary laws have the negative effects towards population, it should have open-mindedness of related persons before the regulatory. Also, it should have the determination of royal act achievement assessment in order to revise after the laws were required.
